TERMS AND CONDITIONS – PICNICS, RESTAURANT SPECIALS AND DINING PACKAGES
These Terms and Conditions apply to all picnic bookings, dining specials, and restaurant packages offered by Toadbury Hall Country Hotel.

| 1.1 | All bookings must be confirmed in advance and are subject to availability. |
| 1.2 | A booking will only be regarded as confirmed once full payment has been received. |
| 2. | Payment Terms |
| 2. 1 | Full payment must reflect in the Toadbury Hall bank account at least forty‑eight (48) hours prior to the booking date. |
| 2.2 | Should payment not reflect within this time period, the Venue reserves the right to release the booking without further notice. |
| 3. | Cancellation Policy |
| 3.1 | Cancellations made less than forty‑eight (48) hours prior to the booking date will not qualify for a refund. |
| 3.2 | No refunds will be issued for no‑shows. |
| 3.3 | Where possible, the Venue may, at its sole discretion, allow bookings to be moved to an alternative date, subject to availability. |
| 4. | Arrival Time |
| 4.1 |
Guests are expected to arrive at or close to the confirmed booking time. |
| 4.2 | Should guests arrive more than one (1) hour after the confirmed booking time, the Venue reserves the right to cancel the booking without refund, although the Venue will attempt to accommodate late arrivals where operationally possible. |
| 5. | Picnic and Dining Service Times |
| 5.1 | The Brunch Picnic offering is served until 12:00 (midday) only. |
| 5.2 | Guests arriving after this time may not be able to receive the brunch picnic offering. |
| 5.3 | The Venue reserves the right to adjust service times where required due to operational considerations. |
| 6. | Food and Beverage Policy |
| 6.1 | No outside food or beverages may be brought onto the property unless prior written permission has been granted by the Venue. |
| 6.2 | The Venue reserves the right to apply corkage or service fees where exceptions are permitted. |
| 7. | Weather and Outdoor Seating |
| 7.1 | Picnics and certain dining experiences may be weather dependent. |
| 7.2 | In the event of adverse weather, the Venue will attempt to provide an alternative location or reschedule the experience, subject to availability. |
| 8. | Conduct and Property |
| 8.1 | Guests are expected to conduct themselves in a respectful manner toward other guests and Venue staff. |
| 8.2 | The client may be held responsible for any damage caused to the Venue’s property, picnic equipment, or facilities. |
| 9. | Right of Admission |
| 9.1 | Right of admission reserved. |
| 9.2 | The Venue reserves the right to refuse service to guests who behave in a disruptive, unsafe, or inappropriate manner. |

TERMS AND CONDITIONS – SMALL CELEBRATIONS, CONFERENCES AND PRIVATE EVENTS
| 1 | Reservations & Booking Confirmation |
| 1.1 | Reservations are subject to availability and are only regarded as confirmed once the Hotel has issued written confirmation and any required deposit has been received. |
| 1.2 | The rates quoted include Value Added Tax (VAT) at 15% unless otherwise stated. |
| 1.3 | The quoted rate includes breakfast unless otherwise specified in the reservation confirmation. |
| 1.4 | Reservations made through third-party platforms remain subject to the cancellation policies and conditions of those platforms where applicable. |
| 2. | Deposit and Payment Terms |
| 2.1 | A 50% deposit of the total accommodation value may be required within 48 hours of making the reservation in order to confirm the booking. |
| 2.2 | The remaining balance must reflect in the Hotel’s bank account no later than twenty-four (24) hours prior to the scheduled check-in time. |
| 2.3 | The Hotel reserves the right to release the reservation should payment not reflect within the required timeframe. |
| 2.4 | Alternatively, where agreed in advance with the Hotel, the outstanding balance may be settled by credit or debit card upon check-in. |
| 2.5 | Where payment is made via Electronic Funds Transfer (EFT), the guest must ensure that the reservation number or surname is used as the payment reference and that proof of payment is sent to the Hotel. |
| 2.6 | If payment has not reflected in the Hotel’s bank account prior to arrival and no prior agreement has been made for payment upon check-in, the Hotel reserves the right to refuse check-in until payment has been received. |
| 3. | Cancellation Policy |
| 3.1 | All cancellations or amendments must be submitted in writing. |
| 3.2 |
The following cancellation fees will apply: 0 – 7 days prior to arrival: 100% of booking value 8 – 14 days prior to arrival: 50% of booking value More than 14 days prior to arrival: No cancellation fee |
| 3.3 | In the event of a no-show, the full booking value will be charged. |
| 3.4 | Any reduction in the number of rooms or length of stay within 7 days of arrival may be treated as a cancellation and charged accordingly. |
| 3.5 | Where a refund is applicable, an administrative processing fee of 7% of the total booking value will be deducted from the refundable amount. |
| 4. | Check-in and Check-Out |
| 4.1 | Check-in time is from 14:00 on the day of arrival. |
| 4.2 | Check-out time is before 11:00 on the day of departure. |
| 4.3 | Early check-in or late check-out requests are subject to availability and may incur additional charges. |
| 4.4 | Guests who fail to vacate their rooms by the designated check-out time may be liable for additional charges equivalent to an additional night’s stay. |
| 5. | Guest Conduct and Right of Admission |
| 5.1 | The Hotel reserves the right of admission. |
| 5.2 | Guests are expected to conduct themselves in a manner that does not disturb other guests or disrupt the operations of the Hotel. |
| 5.3 | The Hotel reserves the right to request any guest causing excessive disturbance, unsafe behaviour, or unlawful conduct to leave the premises immediately without refund. |
| 6. | Damage to Property |
| 6.1 | Guests are responsible for any damage caused to rooms, furniture, fixtures, equipment, or any other Hotel property during their stay. |
| 6.2 | The Hotel reserves the right to charge the guest for the repair, replacement, or cleaning costs arising from such damage. |
| 7. | Lost Property |
| 7.1 | The Hotel accepts no responsibility for loss, theft, or damage to personal belongings brought onto the premises. |
| 7.2 | Any items found after departure will be kept for a reasonable period and may be returned to the guest at the guest’s cost. |
| 8. | Safety and Use of Facilities |
| 8.1 | Guests use the Hotel’s facilities and grounds at their own risk. |
| 8.2 | The Hotel will not be liable for injury, loss, or damage suffered by guests unless such loss or damage results from the gross negligence or wilful misconduct of the Hotel. |
| 8.3 | Parents or guardians remain responsible for the supervision and safety of children at all times. |
| 9. | Keys and Access Devices |
| 9.1 | Room keys must be returned to reception upon departure. |
| 9.2 | A replacement fee of R 300 will be charged for any lost or unreturned room key. |
| 10. | Food and Beverage Policy |
| 10.1 | The Hotel operates as a licensed hospitality establishment and guests are not permitted to bring outside food or beverages onto the property without prior written approval. |
| 10.2 | The Hotel reserves the right to apply corkage or service fees where such permission is granted. |
| 11. | Force Majeure |
| 11.1 | The Hotel shall not be liable for failure to fulfil its obligations where such failure is caused by events beyond its reasonable control, including natural disasters, fire, government restrictions, labour disputes, power failures, or civil unrest. |
| 12. | Protection of Personal Information (POPIA) |
| 12.1 | The Hotel collects and processes personal information in accordance with the Protection of Personal Information Act (POPIA). |
| 12.2 | Personal information will only be used for reservation administration, payment processing, communication regarding bookings, and compliance with legal requirements. |
| 12.3 | Guests may request access to or correction of their personal information held by the Hotel. |
| 13. | Governing Law |
| 13.1 |
These Terms and Conditions shall be governed by the laws of the Republic of South Africa. |

| 1.1 | A booking shall only be regarded as confirmed once the Venue has issued written confirmation and the required deposit or payment has been received. |
| 1.2 | The client acknowledges that the quotation or invoice issued by the Venue reflects the specific package and items selected at the time of booking. |
| 1.3 | Any additional services, items, or changes requested after confirmation will be charged separately and must be specifically requested and confirmed by the Venue. |
| 2. | Final Guest Numbers and Menu Selection |
| 2.1 |
The client must provide the Venue with the final confirmed number of guests, menu selections, and all dietary requirements no later than seven (7) calendar days prior to the event date. |
| 2.2 | This final confirmation will be regarded as the guaranteed minimum number of guests for catering and operational purposes. |
| 2.3 | No reductions to guest numbers will be accepted after this deadline. |
| 2.4 |
No refunds or adjustments will be made for: |

Dietary Requirements |
| 3.1 |
All dietary requirements must be submitted together with the final guest confirmation. |
| 3.2 |
While the Venue will make reasonable efforts to accommodate dietary requirements received within the required time period, late requests may incur additional surcharges. |
| 3.3 |
The Venue cannot guarantee accommodation of dietary requirements submitted less than seven (7) days before the event. |
| 4. |
Payment Terms |
| 4.1 |
Full payment for the event must reflect in the Venue’s bank account at least forty-eight (48) hours prior to the scheduled arrival or event start time. |
| 4.2 |
The Venue reserves the right to cancel the event or refuse access to the premises should payment not reflect within this time period. |
| 4.3 |
Any additional items, beverages, or services requested during the event will be charged separately and invoiced accordingly. |
| 5. |
Venue Allocation |
| 5.1 |
The Venue will discuss and provisionally allocate a suitable space for the event based on the anticipated number of guests and event requirements. |
| 5.2 |
The Venue reserves the right to reallocate the event to a different function space within the property where operational requirements necessitate such change. |
| 5.3 |
Such operational considerations may include, but are not limited to: |

Any alternative space allocated will be appropriate for the size and nature of the event. |
| 6. |
Food and Beverage Policy |
| 6.1 |
No outside food or beverages may be brought onto the property. |
| 6.2 |
Any exceptions must be approved by the Venue in writing prior to the event. |
| 6.3 |
Where written permission is granted, the Venue reserves the right to apply corkage, cakeage, or handling fees. |
| 7. |
Packages and Additional Charges |
| 7.1 |
The quotation or invoice issued by the Venue includes only those items specifically listed within the selected package or confirmed services. |
| 7.2 |
Any additional items requested, including but not limited to: will be charged separately. |
| 8. |
Event Duration and Overtime |
| 8.1 |
The agreed event duration will be communicated and confirmed at the time of booking. |
| 8.2 |
Should the event extend beyond the agreed duration, the Venue reserves the right to charge additional venue hire, staffing, or operational costs. |
| 9. |
Conduct and Damages |
| 9.1 |
The client is responsible for the conduct of their guests at all times. |
| 9.2 |
Any damages to the Venue property, equipment, furniture, or facilities caused by the client or their guests will be charged to the client. |
| 9.3 |
The Venue reserves the right to remove any guest whose behaviour is deemed disruptive, unsafe, or inappropriate. |
| 10. |
Noise and Operational Restrictions |
| 10.1 |
The client acknowledges that the Venue operates within a hotel environment and may host multiple events simultaneously. |
| 10.2 |
The Venue reserves the right to implement reasonable noise restrictions and operational controls to ensure the comfort of all guests on the property. |
| 11. |
Liability |
| 11.1 |
The Venue shall not be liable for any loss, theft, or damage to personal property belonging to the client or their guests. |
| 11.2 |
The client indemnifies the Venue against any claims arising from the conduct of the client or their guests during the event. |
| 12. |
Force Majeure |
| 12.1 |
The Venue shall not be held liable for failure to fulfil its obligations where such failure results from events beyond its reasonable control, including but not limited to: |

Acceptance of Terms |

Acceptance of a quotation, invoice, or booking confirmation constitutes full acceptance of these Terms and Conditions. |
